Information pursuant to Article 13 of Regulation (EU) 2016/679 (“GDPR”)

In compliance with art. 13 (for data collected from the data subject) and 14 (for data not collected from the data subject) of Regulation (EU) 2016/679 (GDPR) the following information is rendered to the Users of this Website, which refers exclusively to the processing performed through said Website and not through other websites that may have been visited via links from this, for which it is suggested that the relevant disclosures made by the respective Holders be reviewed.

This site (which can be called below with the term “application”) collects some Personal Data of its Users.

Users may be subject to different levels of protection. Some Users therefore enjoy superior protection. Further information regarding the protection criteria can be found in the section on applicability.

Types of Data collected

Among the Personal Data collected by this Application, independently or through third parties, there are: name, email, telephone number.

Full details on each type of data collected are provided in the dedicated sections of this privacy policy or by means of specific information texts displayed before the data collection itself. Personal Data may be freely provided by the User or, in the case of Usage Data, collected automatically during the use of this Application. Unless otherwise specified, all Data required by this Application is mandatory. If the User refuses to communicate them, it may be impossible for this Application to provide the Service. In cases where this Application indicates some Data as optional, Users are free to refrain from communicating such Data, without this having any consequences on the availability of the Service or its operation. Users who should have doubts about which Data are mandatory, are encouraged to contact the Owner. The possible use of Cookies – or other tracking tools – by this Application or by the owners of the third party services used by this Application, unless otherwise specified, has the purpose of providing the Service requested by the User, in addition to the further purposes described in this document and in the Cookie Policy, if available.

The User assumes responsibility for the Personal Data of third parties obtained, published or shared by means of this Application and guarantees that he has the right to communicate or disseminate it, freeing the Owner from any responsibility towards third parties.

 

Method and place of processing of the Data collected

Treatment mode

The Data Controller shall take appropriate security measures aimed at preventing unauthorized access, disclosure, modification or destruction of Personal Data. The processing is carried out using IT and/or telematic tools, with organizational methods and logic closely related to the indicated purposes. In addition to the Owner, in some cases, other entities involved in the organization of this Application (administrative, commercial, marketing, legal, system administrators) or external entities (such as third-party technical service providers, postal couriers, hosting providers, IT companies, communication agencies) may have access to the Data, also appointed, if necessary, as Data Processors by the Owner. The updated list of Responsible may always be requested from the Data Controller.

 

Legal basis of processing

The Owner processes Personal Data relating to the User in case one of the following conditions exists:

• the User has given consent for one or more specific purposes; Note: in some legal systems the Owner may be authorized to process Personal Data without the User's consent or another of the legal bases specified below having to exist, until the User objects (“opt-out”) to such processing. However, this is not applicable where the processing of Personal Data is regulated by European legislation on the protection of Personal Data;

• the processing is necessary for the execution of a contract with the User and/or for the execution of pre-contractual measures;

• the processing is necessary to fulfill a legal obligation to which the Owner is subject;

• the processing is necessary for the performance of a task in the public interest or for the exercise of public powers vested in the Owner;

• the processing is necessary for the pursuit of the legitimate interest of the Owner or third parties.

E’ in any case, it is always possible to request the Owner to clarify the concrete legal basis of each processing and in particular to specify whether the processing is based on the law, provided for by a contract or necessary to conclude a contract.

 

Place

The Data are processed at the Owner's operational offices and in any other place where the parties involved in the processing are located. For further information, please contact the Owner. The User's Personal Data may be transferred to a country other than the country in which the User is located. To obtain further information on the place of processing the User may refer to the section relating to details on the processing of Personal Data.

In case of superior protection, the User has the right to obtain information regarding the legal basis of the transfer of Data outside the European Union or to an international organization of public international law or constituted by two or more countries, such as the UN, as well as regarding the security measures adopted by the Data Controller to protect the Data. Where one of the transfers just described takes place, the User may refer to the respective sections of this document or ask the Owner for information by contacting him at the details given at the beginning.

Shelf life

The Data are processed and stored for the time required by the purposes for which they were collected.

Therefore:

• Personal Data collected for purposes related to the performance of a contract between the Owner and the User will be retained for no more than 10 years from the conclusion of the contract.

• Personal Data collected for purposes attributable to the legitimate interest of the Owner will be retained until this interest is satisfied. The User may obtain further information regarding the legitimate interest pursued by the Owner in the relevant sections of this document or by contacting the Owner (info@operaeng.com).

• Personal Data collected for marketing purposes will be retained for no more than one year from the date of collection.

When the processing is based on the consent of the User, the Owner may keep the Personal Data longer until said consent is revoked. In addition the Holder may be obliged to keep the Personal Data for a longer period in compliance with a legal obligation or by order of an authority.

At the end of the retention period the Personal Data will be deleted. Therefore, upon expiration of this term, the right to access, delete, rectify and the right to data portability will no longer be exercised.

 

Purpose of Processing of the Data collected

User Data is collected to allow the Owner to provide its Services, as well as for the following purposes: Contacting the User via email to respond to a question/request expressly sent by the user via the contact form on this site and, only with specific user consent, for marketing and communication services, sending newsletters and communications for direct marketing purposes through emails, text messages, mms, push notifications, fax, paper mail, telephone with operator.

Contact form (Present on this site)

The User, by filling out the contact form with his Data, consents to their use to respond to requests for information, estimates, or any other nature indicated by the form header.

Personal Data collected: name, email and phone.

Only with specific user consent for the purpose of direct marketing through the sending of newsletters and communications through email, text messages, mms, push notifications, fax, paper mail, telephone with operator.

Rights of the User

Users may exercise certain rights with reference to the Data processed by the Owner.

In case of superior protection, the User can exercise all the rights below. In any other case, the User may contact the holder to find out what rights are applicable in his case and how to exercise them.

In particular, the User has the right to:

• revoke consent at all times. The User may withdraw the consent to the processing of his Personal Data previously expressed.

• oppose the processing of your Data. The User may object to the processing of their Data when it takes place on a legal basis other than consent. Further details on the right of opposition are indicated in the section below.

• access your Data. The User has the right to obtain information on the Data processed by the Owner, on certain aspects of the processing and to receive a copy of the Data processed.

• check and request rectification. The User can verify the correctness of their Data and request its updating or correction.

• obtain treatment limitation. When certain conditions are met, the User may request the restriction of the processing of their Data. In that case the Data Controller will not process the Data for any other purpose than its preservation.

• obtain the deletion or removal of your Personal Data. When certain conditions are met, the User may request the deletion of his Data by the Owner.

• receive your Data or have it transferred to another holder. The User has the right to receive his Data in a structured, commonly used and machine-readable format and, where technically feasible, to obtain its transfer without obstacles to another holder. This provision is applicable when the Data is processed with automated tools and the processing is based on the consent of the User, on a contract to which the User is a party or on contractual measures connected to it.

• file a complaint. The User may lodge a complaint with the competent personal data protection supervisory authority or take legal action.

Details on the right of opposition

When Personal Data is processed in the public interest, in the exercise of public powers vested in the Owner or to pursue a legitimate interest of the Owner, Users have the right to object to the processing for reasons related to their particular situation.

Users are advised that, where their Data were processed for direct marketing purposes, they may object to the processing without providing any reason. To find out whether the Owner processes data for direct marketing purposes, Users can refer to the respective sections of this document.

How to exercise rights

To exercise the rights of the User, Users may address a request to the contact details of the Owner indicated in this document. Requests shall be filed free of charge and processed by the Holder in the shortest possible time, in any case within one month.

 

Applicability of the upper level of protection

While most of the provisions of this document apply to all Users, some are expressly subject to the applicability of a higher level of protection to the processing of Personal Data.

This higher level of protection is always guaranteed when the treatment:

• is performed by a Holder based in the EU; i.e

• concerns Personal Data of Users located in the EU and is functional to the offer of goods or services for a fee or free of charge to such Users; or

• concerns Personal Data of Users located in the EU and allows the Owner to monitor the behaviour of such Users to the extent that such behaviour takes place within the Union.

Defense in court

The User's Personal Data may be used by the Owner in court or in the preparatory stages for its possible establishment for the defense against abuse in the use of this Application or the connected Services by the User. The User declares that he is aware that the Owner may be obliged to reveal the Data by order of the public authorities.

Specific information

At the request of the User, in addition to the information contained in this privacy policy, this Application could provide the User with additional and contextual information regarding specific Services, or the collection and processing of Personal Data.

 

System and maintenance logs

Due to operational and maintenance needs, this Application and any third-party services it uses may collect system logs, i.e. files that record interactions and may also contain Personal Data, such as the User IP address.

Information not contained in this policy

Further information in relation to the processing of Personal Data may be requested at any time from the Data Controller using the contact details.

Response to Requests “Do Not Track”

This Application does not support requests “Do Not Track”. To find out whether any third-party services used support them, the User is invited to consult their respective privacy policies.

Changes to this privacy policy

The Data Controller reserves the right to make changes to this privacy policy at any time by informing Users on this page and, if possible, on this Application as well as, if technically and legally feasible, by sending a notification to Users through one of the contact details that the Data Controller has -. Please therefore consult this page regularly, referring to the last modification date indicated at the bottom.

If the changes affect treatments whose legal basis is consent, the Owner will collect the User's consent again, if necessary.

Usage Data

User

The individual using this Application which, unless otherwise specified, coincides with the Interested Party.
